Welcome to GetLostLeads. By using our services, you agree to comply with and be bound by the following Terms of Service. Please read them carefully.
1. The Service
GetLostLeads provides form building, lead capture optimization, and contextual user event tracking. These services are provided as-is and are subject to change or updates without prior notice.
2. Processor-Controller Relationship
For the purposes of the General Data Protection Regulation (GDPR) and other applicable privacy laws:
- You (the Client) act as the Data Controller. You determine the purposes and means of processing personal data collected via your forms.
- GetLostLeads acts as the Data Processor. We process the captured lead data solely on your behalf and in accordance with your instructions.
3. Consent and Regulatory Compliance
As the Data Controller, you are solely responsible for ensuring that you have a valid legal basis (such as explicit consent) under GDPR, CCPA, and India's DPDP Act before deploying the GetLostLeads SDK to collect personal data from users. You agree to configure the SDK compliance parameters to reflect your privacy policy and user preferences.
4. Liability and Indemnity
GetLostLeads is not liable for regulatory fines, legal action, or damage resulting from your failure to obtain user consent or provide an accessible privacy policy. You agree to indemnify and hold harmless GetLostLeads and its affiliates against any third-party claims arising from your breach of global data protection laws.
5. Termination
We reserve the right to suspend or terminate accounts that violate privacy guidelines, engage in unauthorized scraping of credit card or payment fields, or fail to comply with click-wrap agreements.
